Athletics Director Kirby Hocutt said Friday that his office is aware of the city prosecutor’s investigation into a sex tape that allegedly involves student athletes.

The Ohio University Police Department received a tip that a sexual assault was caught on video but after investigating concluded that the incident was an act between two consenting adults, according to an incident report released by the police department.

Sally Linder, OU senior director of media relations, confirmed that the allegations involve students.

The investigation produced additional evidence that the Athens City Prosecutor’s Office is now considering for possible charges.

On Friday, The Athens Messenger reported that the subjects of the investigation include a current or former member of an Ohio athletic team and an athletic department staff member.

Linder said the university will wait until the prosecutor decides whether to file charges before considering any judicial action under the OU code of conduct.

“I am aware of the situation, which is currently still under investigation,” said Hocutt, who declined to comment on whether any student athletes or athletics employees were involved in the case.

“As for now, we are monitoring the process and waiting for (the investigation) to be completed,” Hocutt said.

Athens County Prosecutor C. David Warren said his office originally reviewed the case but found that any potential charges would be misdemeanors and subsequently forwarded the case to Athens City Prosecutor Patrick Lang. The county prosecutor’s office generally handles felony crimes.

Lang would not discuss the nature of any possible charges or confirm that the case involved anyone involved in the Ohio University athletic department.

“There is an ongoing investigation,” Lang said. “But at this time I can’t comment on any details of the case.”

Causing mental or bodily harm by demeaning or disgracing others is prohibited (Section 4.F.) and considered an A-level offense under OU’s student code of conduct. Suspension and expulsion can be considered for A-level offenses.
